Thank you - you were brilliant!! Yay!!
What do you think about "Unappointed lawyer from the Bermuda Triangle". Where did she come from?
No Gal, no CAFCASS, but CAFCASS lawyers are in there. With their statements given 10 minutes after the case was scheduled.

You rescued me in answering the Judge, so massive hugs for that. And he's not put the case back to Judge "Gal's best matey" in the Principal Registry.

The judge knows that we're aiming for COA admittance. He quoted Article 6 himself, so he's seeing stuff that helping us.

And when he asked for CAFCASS's telephone number as he wanted to call them himself. The Bermuda Triangle lawyer /Ex suddenly knew that CAFCASS managers were on "holiday" and not there for the judge to speak to directly. What was all that explosion about?
They never expected the Judge to demand explanations from CAFCASS during the case.
Or CAFCASS's telephone number as he was off to call the buggers himself.
This morning I realised I should have asked them to go for Anthony Douglas directly - there can't be only 1 person running CAFCASS! The judge was in a bad enough mood.
I love the bit when "Bermuda" said it took 6 weeks to get a transcript and judge ridiculed her with "6 weeks - WHO do you get your transcripts from!!".

Tell Gary it was wonderful to meet him. This morning I realised the look on my ex's face - he thought Gary was my boyfriend. Wicked.
Tell Gary I'll stand him a massive drinking session in Dec if he turns up in court. Just to annoy my ex, which will probably be enough of a basis for Gary to turn up!! LOL!

Hi Secrets,

Thanks for the kind words.

I have no clue why the "top solicitor of the Year" was there, thats why we questioned who was paying for her to be present, boy, she wasn't happy with me being present, more so she couldn't do anything about it either, She Knew I would not be a push over and could not be paid off like your old sols were,LOL,LOL

Like I explained to you yesterday, your case has now gone in the right direction, more so the Judge has allowed you to file more applications and add any further requests that you want.

With regards to the Transcript situation, we are onto this now, I know the judge said changes have been made since 1st Oct, also Ross in 1M also pulled out the stops to secure the transcript sooner, this has massive implications to anyone elses appeal or applications, 6 weeks is diabolicle for any case, more so if the transcript is some 10 mins long.

The Judge was not in a bad mood with you but was miffed at the responses from the Sol who just kept palming him off hence the request for the phone number so he could ring Cafcass, it is rare for that to happen in anycase but it has further implications again after the discussion that was had, CAFCASS will not be around much longer, hence their reluctance to become involved. this matter needs looking at as a matter of urgency, are they staying or are they going, I think we all need to know.

I was speaking with a sol in the appeals office who confimed the changes to us and was more in the dark, as was the guy behind the counter.

I am glad things have gone good for you, It is not over by a long shot, more work and time is needed but we are now in the driving seat, it is your case, not theirs, we need to keep it like that at all costs.

Gary well, I never thought about it that way, I will pass on what you said, we could be in the COA with his case by then anyways.

Remember her veiled hisses in the lobby, "you DOOOOOO realise that MKF's can't speak"....

Mum also asks who authorised the lawyers to turn up? She reckons they came there to have you thrown out and to stop you helping me.
If Mr CAFCASS Herr Flick is on hols then we assume he didn't/couldn't authorise their attendance at court.

Either way, without a GAL and without a CAFCASS officer, we have the ex GAL's lawyers gaining admittance to court.
Yet saying to the judge that the GAL has retired, and they can't get another GAL, and that CAFCASS don't want to get involved.

Ohh, and digging the ex gal out of retirement. How can solicitors speak to CAFCASS to get an ex GAL out of retirement.
What is in my paperwork that they don't want anyone to see!

There's a connection there somewhere, if we can just see it.

A good and optimistic potential result. More progress. Well done to you both.

I am glad that the OP is getting progress in the case,

this is one of the more deserving people and the child concerned needs a parent just like this OP. Roll on next hearing!!

Disclosing the case to a former crapcass employee who is no longer bound by crapcass employment laws as they are not contracted to them, in addition to the case being discussed with someone who is NOT a party to proceedings tut tut tut

lol!! I'd forgotten about the ex crying. He's great at the amateur dramatics, you have to give him that.

Yeah LM. Not a party to the proceedings is the big question. If CAFCASS aren't instructed how come CAFCASS lawyers are.

The GAL has retired, and not replaced, so these lawyers are now gaining admittance independently to court. They aren't speaking to my daughter, as the judge asked them that, and their answer was no. They don't intend to pass letters to my daughter as Mob asked them that. Their answer was they were only involved during the proceedings. But they instructed themselves, appear to have negotiated legal aid for themselves, but have no contact with the child.

If anyone can make sense of this, I'm sure Mob and myself would be happy to take a sounding on what their angle will be to the legal aid board.
They wouldn't turn up without funding. But can they self instruct? Without contact with the child. So they can't be working for the child as they don't intend to speak to her. CAFCASS don't intend to get involved as they're saying "Gillick competent". Which means my ex must have instructed them, on behalf ofmy daughter. Now if they're not speaking tothe child, how can they represent her?
