Hi I am a MKF for a parent, the kids at home on a supervision order, however SS are trying to get them back into care of a breach of the order. In the Directions its asking mum to:

1, a case summary setting out -

a) thier proposals for the long term future of the child (to include placement and contact)

b) thier reply to the Local Authority's schedule of Proposed Findings;

c) any proposal for assessment/expert evidence: and

d) names and addresses of any family members who is is suggested be approached relation to long term care/contact or respite.

ii) Initial witness statements.


Now I have the case summary from the LA, Do I subtitle it as they have,
But put what we want which is the opposite of what they have put.

so far we have done a 16 page responce to the social workers statement, the finding are just a copy of old stuff from the last hearing ie 10 day final hearing, that let the mother keep her children, The LA are using the same old stuff that went into court in the first place which she fought out over a 10 day final hearing. They have used stuff that the judge dismissed. The Judge himself during the final hearing said he had been overly critical in his previous judgement, the LA lost after 4 years of trying even though mother won, they are dragging old stuff up. The Barrister for the LA said when we went into court a couple of weeks ago, that we were only dealing with the breach and nothing else only the LA have dragged everything up in thier summary and also the new social worker has just repeated it all in her statement.

Its like having another final hearing, in which case we want a complete retrial as it was a corrupt hearing the last time round.

Has any one else had to do there own case summary etc. It was supposed to be in court by 26th but my pc broke and I have tonight to type up and print off her answers to the summary and the other questions. heaing 14/15th october.

Can you get transcripts of the previous hearings where the judge dismissed the LA's original evidence? That way you can refer to that.

I would also include evidence that the parents may have in the case summary that the judge can easily refer to.

I would use the headings that the judge has given you and respond to each of the questions/headings the judge has given you individually. Prepare it like an official court report like the LA do. Remind the judge of what they have asked for, and prepare responses for each heading. So for example;

On such and such a date Judge X asked for the following;

a) thier proposals for the long term future of the child (to include placement and contact)

b) thier reply to the Local Authority's schedule of Proposed Findings;

c) any proposal for assessment/expert evidence: and

d) names and addresses of any family members who is is suggested be approached relation to long term care/contact or respite.

ii) Initial witness statements.

A Proposals for the long term future of the child (to include placement and contact)

Mr and Mrs X believe that the long term future of the child is for the child to reside with them - (the parents) and that a placement outside of the parents care is not in the child's best interests.

B reply to the Local Authority's schedule of Proposed Findings;
Use this section to really slate the LA if applicable and quote evidence, case law etc.
Mr and Mrs X deny harming their child in any way. Since the child has been returned the child has made significant progress in school (enclose school reports) and has improved attendance at school (enclose attendance records). The child has been socialising well with other children and attending out of school activities (enclose proof) etc. Along these sort of lines and go into great detail to go all out to prove the LA wrong. If the LA say the parents have a messy home - take photo's of the home and prove the LA wrong enclose it all in this summary.

Hi thank you, yes we have the full transcript, which we have quoted which is why her statement is 16 pages long, we tried to get the same Judge but unfortunaltely he has retired and is on a part time basis and as a rule they dont use part timers now in cases like this one !!! and he has not yet been sworn back into his new part time position. however he has been requested. This is why the LA are doing the dirty as if it went back in front of him they would'nt dare write half of the stuff as it came out during the final hearing that the social worker had tried to pervert the course of justice, and no nothing was done apart from the judge agreed to a change of social services departments and a new social worker for the family. The old social worker is carrying on with other familys the same. this is why we need to keep fighting for accountability and openess in the Family courts, he would have been put in prison had it been in a criminal court.

The Judge in this case said and we have quoted it in bold type the LA were "wholy deplorable" shame the judgements and transcripts cant be published.

Strictly Article VI of ECHR says all judgments should be in public. This could be taken as being anonymously in public. This is, however, something that I have not tested as yet.

If the CoE investigation kicks off this week then it should be covered by article XI of the 1688 Bill of Rights which should give privilege to anyone giving evidence.

children in parent's life is most important because only they are thinking or planning & managing something for their living facilities & preventing any problem against them while getting up for some goal . . but somehow situation happened bad with their children & parent think to recover them very fast because without them they are nothing to plan for in living life sympathy words . .
