Magistrates Courts

I would like to see the responsibilty for family law taken away from the Mages so that these cases only go to a proper trial judge . The SS seem to have more power here as opposed to the county court from what I've personally observed.

You can ask the Magistrate to consider a transfer to County court.

If you don't agree with the court process or procedure, put in an appeal. EX340 (i think) Appeal to CC.

They refused to do that when my sol asked for transfer. She said case would have been thrown out if gone to county. Instead I had to endure people (mags) not knowing the law and just going along with SS. The court clerks are too friendly with the LA sols in mags courts.

An alternative is to apply for a child to be a ward of court (never done this) to stop lower courts having any jurisdiction.

We are getting better at the appeal processes. We need to identify some people who have done appeals from the magistrates courts so that this can happen as LIP support.

I am looking a case at the moment where the parent/s are in the magistrate court. From what I can hear about the case, there are several things not done. The parent I am dealing with doesn't want to be LIP in any hearing (not sure why - yet)

I should know more with in a week or so.

If it were possible I would get all my clients to do this. Sadly it isn't. You have to let the process run it's course. You do get a better class of legal brain in the CC over the Mages

This is correct but it is a High Court issue only. It p[uts a block on anything nasty going on. I am waiting to do this one.

OUR SOLICITOTER TOLD US WE GOING TO COURNTY COURT WE FOUND OUT ON THE DAY IT WAS THE MARAGARTS COURT HE FUCKED US GOOD AN PROPERY KEEPET OUR WITNESS AND EVEDAINCE AS WELL MADE SHORE WITH S S THAT WE LOST THE CASE I DONT KNOW HOW MUCH MORE MY FERANICE CAN TAKE......
