discharging care orders

Postby moochymoo on Sun Sep 20, 2009 12:26 pm

Hi I am new on here. Has anybody got any success stories and had their kids returned after a care order been granted or is it?. My kids are not happy in their foster home. My 12 year son told me in contact. Luckily this will be on CCTV. mY KIDS SUPPOSED TO BE ON A FULL CARE ORDER. tHIS WAS AT THE FINAL HEARING WITHOUT A INTERIM CARE ORDER OR ANY EPO. Somebody who writes articles on the web said that this is an interim care order. They have been gone for six months. LONG TERM FOSTER CARE.

If your children are in care they are entitled to help from an organisation called VOICE.

Voice are funded by the National Lottery (not the SS).

You cannot call them. YOUR CHILDREN have to make contact and ask Voice for help to go home.
Give your kids the telephone number for voice or give them their website.

Voice contact details

You need to "gang up" against the SS. Parent + child stand a better chance against the SS than you as a parent alone. The SS's solicitor is NOTa childs solicitor they are there to protect the GAL/SS ONLY. Voice are there to even up the balance of power.

Good luck!!

Voice - Tel 0808 800 5792 Free.

Email - info@voiceyp.org
Once you're 12 years old, you can fire your CAFCASS Guardian, and hire your own legal team.

If you're in a care home, then you'll need specialist lawyers - so call VOICE.
They're free, so won't cost your mum and dad anything.
If you go to court to ask the judge to be returned home, and your parents are fighting for you, then it's 2 to 1 in court, against the Social Workers.

Check what the care orders they are actually on as there are often irregularities.

Ring the court office and ask for copis or get them off your former solicitor.

Meanwhile you must get Voice in by getting your son to call them. The problem is giving him the helpline number and explaining who they are without the SS finding out and stopping it.

Moochymoo if you want to chat about discharging care orders PM me. I am currently LIP with on-going litigation to discharge care orders for my children.

Your first port of call is to write to the LA to ascertain exactly what orders your children are subject to, if any at all. You could bypass the SW and write directly to the Corporate Director and say you want a copy of the orders which are in place.

My thread is 'SS Applying For A Recovery Order' if you want to take a look at it.

DO NOT Ask the L.A for the current care order status of the Children, the L.A could say anything to you.

Your first port of call would be to go to the court and ask for all current and previous orders.

The L.A don't have a duty at the moment to provide you with anything, this would change if you became a Litigant in person and do the case yourself, then and only then would the L.A have a duty to supply you with the full court bundles including the court orders.

Can I ask that you speak with Emily Wilson-Gavin regarding your matter, there are people who could assist you with your case.

Just outline your case and email Emily.

Thanx ppl, my eldest boy in care, is now being bullied ca ppl have found out, he is suicidal sometimes. He dnt trust the carer or his sw. The sw now knows the boys wanna cum home and has advised my hubs to seek legal help. He dnt want us to be disappointed if our boys are not home for xmas, itf we havent approached legal help to reverse a care order. He claims he dnt know the boys are suffering without there mam and dad. My boy told me this on numerous occasions in contact overheard by the supervisors. I asked him if he knew of voice . He didnt. So i told him they listen to kids in care. I will sneak the numba to him in contact. They all know now there might be a way to cum home if they can tell somebody how they truly feel. Somebody been filling my baby head that mummy and daddy are child abusers and he says we are not. Hes six years old.
