You both need to speak to the PCT Complaints Commission and get them to support you as I have. Once you have them batting for you, along with any doctors, then the other parties and the judge know they are p*ing in the wind and their only recourse of action is the Caldicott Guardian. Of course it would be wise to find out whom that is and make enquiries with them about disclosure.

If any Dr, GP, Consultant, Therapist etc etc were to speak to the CG and state they did not think it relevant to disclose the records then the CG is the one to take over. Get this in writing to the nasty lil judge, they will know they are pushing it. If the judge wants to subpoena the CG with your medical records that would be the only way.

It is very common for appeal applications to be "lost", indeed almost standard, in "controversial" cases.

The degree of dishonesty behind the scenes is simply staggering.

I can't believe that for July/August/Sept/Oct the court lost the papers. I can't believe they schedule and held an URGENT case without a single piece of paper let alone a court bundle for the judge. OMG!!

The day we reissued an ENTIRE new case and started from scratch AGAIN, the court called me at home to say "oh look, I'vefound the papers, today they've just TURNED up on my desk".

grrrhhhhhh

They even used a SS TONE on me. All happy clappy.

I've seen a case where the papers were lost for nine months, including the application for a judgement, then mysteriously turned up on someone's desk.

Complaints should be made to the central HMCS Customer Relations section, it works wonders.
